Terms of Service

Agreement

By using frostygrins.shop or placing an order, you agree to these Terms of Service and to our Shipping Policy, Refund Policy and Privacy Policy. If you do not agree, please do not use the site. You must be at least 18 years old, or the age of majority where you live, to place an order.

Products

We make every effort to describe and photograph our products accurately. Some images on our site are styled or illustrative, and colors, light effects and sizes may look slightly different in person. The Frosty Grins Talking Snowman is a holiday decoration with small parts (hat, scarf and removable arms) and batteries; it is not intended for children under 3, and young children should use it with adult supervision.

Orders

Your order is an offer to buy. We accept it when we ship it. We may refuse or cancel any order, for example if an item is unavailable, if we suspect fraud, or if there is an error in the price or description. If we cancel an order you have paid for, we will refund you in full.

Prices and promotions

• All prices are in US dollars. Applicable sales tax is calculated at checkout.
• Prices and promotions may change at any time without notice. The price that applies is the one shown at checkout when you place your order.
• Promotions cannot be combined unless stated, and have no cash value.
• If a product is listed at an incorrect price because of an error, we may cancel the order and refund you, even after confirmation.

Payment

Payments are processed securely by Square. By submitting payment, you confirm that you are authorized to use the payment method. Your card is charged when you place the order.

Shipping, returns and refunds

Shipping is governed by our Shipping Policy. Title and risk of loss pass to you when the order is handed to the carrier, but we will still help with lost or damaged packages as described in that policy. Returns and refunds are governed by our Refund Policy.

Reviews and content you send us

If you send us a review, photo or video, you confirm it is your own and truthful, and you give us permission to display it on our site and social media with your first name and last initial. We do not edit the meaning of reviews, and we disclose when a reviewer received a free or discounted product.

Intellectual property

The Frosty Grins name and logo, and the text, graphics, photos and design of this site, belong to Frosty Grins or are used with permission. You may not copy, reproduce or use them without our written permission.

Acceptable use

You agree not to misuse the site, including placing fraudulent orders, interfering with its operation, scraping it, or attempting to access data that is not yours.

Disclaimer

Except for the guarantees we expressly provide in our policies, the site and products are provided “as is” and “as available” to the fullest extent permitted by law. Nothing in these terms limits any rights you have under consumer protection laws that cannot be waived.

Limitation of liability

To the fullest extent permitted by law, Frosty Grins is not liable for indirect, incidental or consequential damages, and our total liability for any claim relating to an order is limited to the amount you paid for that order.

Indemnity

You agree to cover any claims, losses or costs (including reasonable legal fees) arising from your misuse of the site or breach of these terms.

Disputes and governing law

If you have a problem, please contact us first at support@frostygrins.shop. Most issues are resolved quickly. These terms are governed by the laws of the State of Missouri, without regard to conflict-of-law rules. Any dispute that cannot be resolved informally will be handled in the state or federal courts located in Missouri, except that either party may bring a qualifying claim in small claims court.

Changes to these terms

We may update these terms from time to time. Changes apply to orders placed after they are posted. The date at the bottom shows the latest version.
